Acceptance of terms
By accessing or using SmartGringo (the “site”), you agree to be bound by these Terms of Service. If you do not agree, do not use the site.
Description of service / affiliate disclosure
SmartGringo is owned and operated by Tobination LLC, a South Dakota limited liability company. SmartGringo is not an insurance agent, broker, or carrier. We are an independent affiliate of the insurance providers featured on this site, including Baja Bound Insurance Services, IMG Global, and Travel Medical Insurance Network. We earn a commission when visitors purchase a policy through our referral links. All policies, quotes, claims, coverage decisions, and customer service are handled directly by the respective insurance providers. SmartGringo does not sell, underwrite, bind, or service insurance policies of any kind.
Eligibility
You must be at least 18 years old and legally able to enter into binding contracts to use this site. By using SmartGringo you represent that you meet these requirements.
Permitted use
The site is provided for general informational purposes only. Nothing on SmartGringo is legal, financial, tax, or insurance advice. Specific coverage, eligibility, pricing, and claims decisions are made by the relevant insurance provider, not by SmartGringo.
Third-party links and providers
SmartGringo links to insurance partners and other third-party sites. Your relationship with any partner or third party is governed by that party’s own terms and privacy policy. Tobination LLC is not responsible for the content, quotes, claims handling, coverage decisions, or business practices of partner providers or any other linked site.
Intellectual property
All site content — including text, graphics, layout, logos, and code — is owned by Tobination LLC or its licensors and is protected by copyright and trademark law. You may not reproduce, republish, or commercially reuse any portion of the site without prior written permission. Brief quotation with attribution and a link back is permitted.
User submissions
Any message, question, or other content you send through the contact form or by email is non-confidential. By submitting content, you grant Tobination LLC a non-exclusive, royalty-free, worldwide license to use, store, and process that content for the purpose of operating the site and responding to you. Do not send sensitive personal, medical, or financial information through the contact form.
Disclaimer of warranties
The site is provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.
Limitation of liability
To the fullest extent permitted by law, Tobination LLC, its members, officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising out of or related to (a) your use of, or inability to use, the site; (b) decisions you make based on information found on the site; or (c) the actions, inactions, content, or services of partner insurance providers or other third parties. Aggregate liability is limited to one hundred U.S. dollars (USD $100).
Indemnification
You agree to indemnify, defend, and hold harmless Tobination LLC and its members, officers, employees, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the site, your violation of these terms, or your violation of any law or third-party right.
Modifications to these terms
We may update these Terms of Service from time to time. Changes take effect when posted to this page. Your continued use of the site after a change constitutes acceptance of the updated terms. We will update the effective date above when we make material changes.
Governing law and venue
These terms are governed by the laws of the State of South Dakota, USA, without regard to its conflict-of-laws provisions. Any dispute arising out of or related to these terms or your use of the site will be resolved exclusively in the state or federal courts located in South Dakota, and you consent to personal jurisdiction there.
Severability
If any provision of these terms is found to be unenforceable, the remaining provisions remain in full force and effect.
